SUMMARY

This position will serve as the day-to-day manager of compliance activities for the Diversified Services division of Cherokee Nation Businesses, L.L.C. (the “Division”).  This role is responsible for overseeing and monitoring the Ethics & Compliance Program at the direction of the Compliance Officer to promote an organizational culture that encourages ethical conduct and ensure that business practices and activities comply with regulatory requirements and internal policies, including, but not limited to those relating to federal government contractors. 

 

ESSENTIAL DUTIES AND RESPONSIBILITIES

Includes the following (other duties may be assigned):

  • Oversee, monitor and lead the Ethics & Compliance Program for the Division.
  • Serve as subject matter expert on regulatory compliance matters related to conducting business with the US government.
  • Understand and maintain awareness of current regulatory requirements and changes: Federal Sentences Guidelines, Mandatory Disclosure, Anti-Kickbacks Statues, Foreign Corrupt Practices Act, False Claims Act, Organizational Conflict of Interest and other similar requirements in order to provide potential compliance risk areas to the Compliance Officer.
  • Ensure appropriate communication of the regulatory changes and the development of policy and procedure in response to regulatory changes.
  • Assist with providing and advise to the corporate and administrative staff to support overall compliance with government contract requirements.
  • Identify compliance deficiencies and assist in implementing corrective actions to help ensure adherence to government requirements.
  • Perform analysis of contract compliance.
  • Develop and oversee the educational and training programs for all employees, agents, contractors, or others working within the organization.
  • Review and provide recommended implementation actions of contract compliance standards for Diversified companies.
  • Conduct, monitor, or investigate allegations of misconduct and resolve the same as necessary.
  • Oversee Compliance Program Audits.
  • Prepare accurate and timely quarterly and yearly reports, including updating current projects and compliance reporting to the Compliance Officer.
  • Assist in creating reports to the Board of Directors’ Risk Committee for the Compliance Officer on compliance issues and lead appropriate corrective and mitigation actions as directed by the Compliance Officer.

 

SUPERVISORY/MANAGEMENT AUTHORITY

Responsible for managing an area but does not directly manage staff.

 

EDUCATION and/or EXPERIENCE

  • Undergraduate degree required; Master’s Degree, J.D. or other advanced degrees in business or law preferred.
  • Minimum of 10 years of experience, ideally including a minimum of 5 of those years in a in positions of continuous growth or leading ethics and compliance role or law firm focusing on government contract compliance matters.
  • CCEP or other Compliance & Ethics Certification, preferred

 

KNOWLEDGE, SKILLS AND ABILITIES

  • Familiarity with ITAR, EAR and Global Trade, preferred,
  • Experience managing and developing a compliance program,
  • Knowledge of laws, regulations and industry standards relating to federal procurement, such as the FAR/DFARS, and others relating to Code of Business Ethics and Conduct requirements, gratuities, hiring former government officials, the Procurement Integrity Act, organizational and personal conflicts of interest, truthful cost and pricing data, combatting trafficking n persons, qui tam rules, and data security, and a working knowledge of varying types of government contracts (FFP, T&M , IDIQ, CPFF, performance based, etc.),
  • Though not required, familiarity with the following will be a plus:  A working knowledge of federal small business programs such as the SBA 8(a) Program, HubZone, SDB, Mentor-Protégé, and TERO; and familiarity with Industrial Security regulations (NISPOM), and security clearance compliance.
  • Experience with MicroSoft Office products
  • Must demonstrate excellent written and oral communication skills with ability to effectively interface with customers (internal and external) from the working to executive levels
